1. Agreement to Terms

By accessing or using any service provided by The Daniel Morante Company, Inc. d/b/a Pacy World ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

Pacy World provides web hosting, email hosting, web design, virtual private server (VPS), and colocation services. Service details, pricing, and specifications are described on our website and in any applicable service agreement.

3. Account Responsibilities

• You must provide accurate, complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to create an account.

4. Acceptable Use

You agree not to use our services to:

• Host, transmit, or distribute illegal content.
• Send unsolicited bulk email (spam) in violation of the CAN-SPAM Act.
• Engage in activities that disrupt service to other customers.
• Store or distribute malware, phishing pages, or exploit kits.
• Violate any applicable local, state, national, or international law.
• Infringe on the intellectual property rights of others.

We reserve the right to suspend or terminate accounts in violation of this policy without prior notice.

5. Payment & Billing

• Payment is due on the first day of each billing cycle unless otherwise agreed.
• Accounts past due by 15 days may be suspended.
• We accept credit/debit cards and electronic bank transfers.
• Prices are subject to change with 30 days' written notice.

6. Uptime & Service Level

We target 99.9% uptime for shared hosting and VPS services. Scheduled maintenance windows are announced at least 48 hours in advance. Our Satisfaction Guarantee details remedies for extended outages.

7. Backups & Data

While we maintain daily backups as a courtesy, you are ultimately responsible for maintaining your own backups. We are not liable for data loss. We recommend using off-site backup solutions in addition to server-level snapshots.

8. Limitation of Liability

To the maximum extent permitted by law, Pacy World shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, regardless of cause.

9. Termination

Either party may terminate services with 30 days' written notice. We may terminate immediately for violations of these terms. Upon termination, you must retrieve your data within 15 days; after that period, it may be permanently deleted.

10. DMCA

We comply with the Digital Millennium Copyright Act. See our DMCA Policy for details on submitting takedown notices and counter-notifications.

11. Governing Law

These terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Collier County, Florida.

12. Changes

We may update these terms at any time. Material changes will be communicated via email or prominent website notice at least 30 days before taking effect.
